The federal hemp definition includes a delta-9 THC threshold, while product legality can also depend on current federal, state, and local rules.
Public product areas require age confirmation, and additional checks may apply by jurisdiction or provider.
Product availability and shipping eligibility are determined by the customer's state and local laws.
Supplier and testing documentation must be reviewed for each listed regulated product.
EMPYRE products are derived from hemp, as defined under the Agriculture Improvement Act of 2018 (the '2018 Farm Bill'). The Farm Bill removed hemp — defined as Cannabis sativa L. and any part of the plant with a delta-9 tetrahydrocannabinol (Δ9-THC) concentration of not more than 0.3% on a dry weight basis — from the Controlled Substances Act. Hemp-derived products meeting this definition are federally legal to cultivate, process, and sell in the United States.
Some listed products may contain THC-A (tetrahydrocannabinolic acid). The legal treatment of THC-A and total THC can depend on current federal, state, and local law, testing methodology, product form, and intended use. EMPYRE's checkout applies approved jurisdiction rules, but buyers and IBOs should not treat a catalog listing as legal advice.
While hemp-derived products are federally legal under the 2018 Farm Bill, individual states and local jurisdictions have enacted their own laws regulating hemp, cannabinoids, and cannabis products. These laws may restrict or prohibit the sale, possession, or shipment of certain products. EMPYRE monitors state regulations and restricts product availability and shipping eligibility based on the customer's jurisdiction. IBOs and customers are responsible for confirming that products are legal in their location before purchasing.
All EMPYRE platform users — including IBOs and retail customers — must verify that they are 21 years of age or older before accessing the platform, viewing products, or making a purchase. Age verification is required at platform entry and at checkout. Selling or distributing EMPYRE products to anyone under 21 is strictly prohibited and will result in immediate account termination and potential legal action.
EMPYRE products are not evaluated or approved by the U.S. Food and Drug Administration (FDA). EMPYRE products are not intended to diagnose, treat, cure, or prevent any disease. IBOs and marketing materials must not make health or medical claims about any product. The FDA has not established regulations for hemp-derived cannabinoid products beyond CBD, and EMPYRE complies with all applicable FDA guidance regarding dietary supplements and hemp products.
Regulated products should be listed only after applicable supplier, licensing, labeling, and laboratory documentation has been reviewed. A current Certificate of Analysis, where applicable, should be matched to the product or batch before sale. Availability may be paused when required documentation is missing or outdated.
EMPYRE restricts the shipment of hemp-derived products to states and territories where they are legal. The following jurisdictions may have restrictions on certain product categories: Idaho, Iowa, Nebraska, and others as regulations evolve. Product availability and shipping eligibility are determined at checkout based on the customer's shipping address. EMPYRE reserves the right to refuse or cancel orders shipped to restricted jurisdictions.
IBOs are responsible for understanding and complying with the hemp and cannabis laws in their jurisdiction. IBOs must not: (a) market products as medical treatments; (b) sell or distribute products to minors; (c) ship products to restricted jurisdictions; (d) make claims about product effects that are not substantiated. EMPYRE provides compliance training through the Academy, but IBOs remain solely responsible for their own legal compliance.
EMPYRE products are derived from federally legal hemp, not marijuana. Marijuana — Cannabis sativa L. with more than 0.3% Δ9-THC — remains a Schedule I controlled substance under federal law. EMPYRE does not sell, distribute, or facilitate the sale of marijuana or marijuana-derived products. All EMPYRE products comply with the federal hemp definition under the 2018 Farm Bill.
Hemp and cannabis laws are evolving rapidly at both the federal and state levels. EMPYRE monitors regulatory developments and updates its compliance policies, product availability, and shipping restrictions accordingly. This page will be updated as laws change. IBOs and customers should check this page regularly for the most current compliance information.
Important: This compliance page is for informational purposes only and does not constitute legal advice. EMPYRE is not a law firm and cannot advise IBOs or customers on the legality of hemp products in their specific jurisdiction. IBOs and customers should consult qualified legal counsel for jurisdiction-specific guidance.
