By accessing or using the EMPYRE platform (the "Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. The Service is operated by EMPYRE and is available to Independent Business Owners ("IBOs") and retail customers.
You must be at least 21 years of age to access the Service, create an account, or purchase any products offered through the platform. By using the Service, you represent and warrant that you are 21 or older and meet the legal age requirement in your jurisdiction. Age confirmation is required before entering public product areas; additional identity or age checks may be required where applicable.
IBOs are independent contractors, not employees, agents, or representatives of EMPYRE. IBOs are solely responsible for their own business activities, taxes (including self-employment taxes), licenses, and compliance with all applicable local, state, and federal laws. EMPYRE does not guarantee any income or success. IBOs are not entitled to any employee benefits, workers' compensation, or unemployment insurance.
EMPYRE utilizes a hybrid matrix compensation structure. Commissions and bonuses are calculated based on personal volume and group volume as defined in the compensation plan. EMPYRE does not guarantee any level of income. Earnings are based solely on actual product sales and team volume. Most participants earn little or no income. IBOs must reference EMPYRE's Income Disclosure Statement when making any income claim. EMPYRE reserves the right to modify the compensation plan at any time. Products sold through the platform are derived from federally legal hemp as defined by the 2018 Farm Bill (≤0.3% Δ9-THC) and are intended for adults 21+. Products are not evaluated or approved by the FDA and are not intended to diagnose, treat, cure, or prevent any disease. IBOs and customers must comply with all applicable laws regarding the sale, marketing, distribution, and shipment of these products, which vary by jurisdiction. EMPYRE's compensation plan is based on actual product sales to retail customers, not on recruitment alone. Commissions are earned when products are sold through an IBO's storefront or by their downline. EMPYRE does not pay commissions merely for recruiting new IBOs. Compensation under the current production plan is tied to verified retail sales, and recruitment alone does not generate compensation. IBOs must not: (a) recruit with promises of guaranteed income; (b) represent that income is passive or requires no effort; (c) make any income claim not substantiated by the Income Disclosure Statement.
You agree not to: (a) make false, misleading, or unsubstantiated income claims; (b) engage in deceptive or unlawful recruiting practices; (c) sell products to minors; (d) misrepresent the compensation plan; (e) use spam or unsolicited communications; (f) make health or medical claims about products; (g) show commission checks or screenshots as income proof; (h) use testimonials that suggest typical results without referencing the Income Disclosure Statement; (i) violate any applicable law or regulation.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify EMPYRE immediately of any unauthorized use.
EMPYRE may suspend or terminate your account and access to the Service at any time, with or without cause, including for violation of these Terms or compliance guidelines. Upon termination, any pending commissions may be forfeited at EMPYRE's discretion.
The Service is provided "as is" without warranties of any kind. EMPYRE does not warrant that the Service will be uninterrupted, error-free, or secure. Products are provided without warranty of any kind, express or implied.
To the maximum extent permitted by law, EMPYRE shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service or products purchased through the platform.
IBOs agree to indemnify and hold EMPYRE harmless from any claims, damages, or legal actions arising from the IBO's own business activities, marketing practices, income claims, or violations of law.
EMPYRE may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
These Terms shall be governed by the laws of the applicable jurisdiction without regard to conflict of law principles.
